When Must Employers Offer ADA Accommodations?
To be required under the Americans with Disabilities Act (ADA) to offer an accommodation, an employer must have reason to know:
(1) that an employee has a disability
(2) that an employee has a problem at work
(3) that (1) and (2) are related
But, if the employer has reason to know (3) — to suspect that (1) and (2) are related — then it should ask if accommodations are needed. For case examples, see Offer Accommodations Not Retirement and The Unconscious Need Not Ask.
